TERMS AND CONDITIONS OF LE CLUB LADURÉE

ARTICLE 1 : Preamble


1.1 PATISSERIE E. LADUREE, a société par actions simplifiée (simplified joint stock company) with capital of €372,204, registered in the Paris Trade and Companies Register under number 572 045 540, whose registered office is located at 84 avenue d'Iéna, 75116 Paris, FRANCE (hereinafter referred to as "LADUREE"), has created and manages a loyalty program called "the LADUREE Club" (hereinafter referred to as the "Program") intended for its customers making a purchase in one of the eligible Ladurée boutiques (see §1.2) or on the website www.laduree.fr (hereinafter referred to as the "Website").

1.2 The purpose of these general terms and conditions relating to the Program (hereinafter the "General Terms and Conditions") is to set out the terms and conditions of membership and operation of the Program. Any person joining the Program is deemed to have read and accepted the General Terms and Conditions without reservation.

The Program is valid for purchases made on the Internet Site and in the following Ladurée boutiques:

(hereinafter the "Boutiques").

1.3 As the General Terms and Conditions may be subject to subsequent modifications, the version applicable to the customer's purchase is that in force on the Internet Site on the date the order is placed. They shall prevail over any other version or any other contradictory document. LADUREE therefore invites customers to reread the current General Terms and Conditions carefully each time they place a new order.


ARTICLE 2: Purpose

The Program enables its members (hereinafter the "Member(s)") to benefit from advantages, services and/or offers proposed by LADUREE.


ARTICLE 3 : Membership and validity

3.1. Membership is open to all individuals over the age of 18. It is not possible to benefit from the Program for a legal entity (company, professional organization, association...). If you have ticked the professional box when creating your web account, you cannot benefit from the advantages of the "Club Ladurée".

3.2. Only one membership application per person will be considered. LADUREE may at any time request any document to prove the identity of the person wishing to subscribe or having subscribed to the Program, particularly in the event of homonymy.

3.3. Enrolment in the Program is free of charge and is offered on the LADUREE website when an account is created on www.laduree.fr or when a purchase is made in the Boutiques via a form available on the tablet or by scanning a QR code with the customer's cell phone, or directly with a sales advisor.

To join the Program on the www.laduree.fr website, the customer must create an account in the tab provided for this purpose.

3.4 Registration forms containing incomplete or erroneous data will not be taken into account. The Member is responsible for the accuracy of the information provided at the time of registration. Members may modify their personal information by contacting customer service via the contact form on the Website or at contact@laduree.com.

3.5. Membership of the Program implies acceptance of these General Terms and Conditions by the Member. These General Terms and Conditions can be consulted on the LADUREE website www.laduree.fr. Once membership has been validated, the Member will receive a welcome e-mail from which he/she will be able to download a dematerialized card and once again consult the present General Conditions.


ARTICLE 4: Content

4.1 The Program enables the Member to receive communications relating to the Maison Ladurée and the events it organizes. In addition, the Member will benefit from advantages such as a gift against purchase for his/her birthday and access to LADUREE private sales.

4.2 The list of benefits offered may be modified at any time by LADUREE.

4.3 LADUREE benefits may under no circumstances be transferred or exchanged for cash.


ARTICLE 5 : Benefits

5.1. Notification of advantage: The Member will receive an email indicating an advantage or a discount code to be used on the Website and/or in the Boutiques.

5.2 Obtaining the benefit: the Member may benefit from his benefits i) on the Internet Site after having identified himself, and by entering his code at the time of purchase or (ii) directly in Boutiques by presenting his LADUREE dematerialized card (iii) by giving his name at the checkout to the sales advisor.

5.3 Non-cumulation with LADUREE employee benefits: it is specified that LADUREE employees registering with their @laduree.com business address will not be able to obtain the benefits of the Relationship Program in addition to the specific benefits reserved for employees. The LADUREE salaried Member must choose either to benefit from the discounts linked to his/her status or to benefit from the Program.


ARTICLE 6: Linking customer accounts created in Boutiques and created on the website

When the Member has opened an in-store account to benefit from the Program and subsequently wishes to link an online order to his/her loyalty account, he/she must :

1/ Choose the option to open an account on the www.laduree.fr website;

2/ Use the same email address as the one provided in Boutiques when registering.

The account number linked to the Program will then be directly associated with the Member's web account.


ARTICLE 7 : Personal data

7.1. Registration for the Program implies that the Member provides the information listed below at the time of joining:

Country of residence (in Boutiques)

Zip or postal code

Date of birth

Phone

Language preference

Information followed by an asterisk (*) must be filled in at registration. Other information is optional. Members are invited to provide this information in order to receive news and offers that are even more likely to be of interest to them.

7.2. The information collected, on the basis of the Member's or future Member's consent, when joining and using the Program is processed by LADUREE's departments for the following purposes:

Consider memberships and manage the Program;

Send the Member information, commercial and promotional offers from LADUREE.

7.3 In accordance with the regulations applicable to the protection of personal data, the Member may, at any time, decide to withdraw his/her consent by sending an e-mail to privacy@laduree.fr or by post to the following address: Service Juridique - 84 avenue d'IĂ©na, 75116 Paris, FRANCE.

He may also consult and modify the information communicated by contacting customer service at contact@laduree.com.

Information specific to the processing of the Member's personal data is given in the Data Protection Charter available here.

The Member may also lodge a complaint with the Commission Nationale Informatique et Libertés ("CNIL"), the supervisory authority responsible for compliance with obligations relating to personal data.


ARTICLE 8: Termination

8.1 Termination by the Member

8.1.1 Members may cancel their membership of the Program at any time, either by clicking on the unsubscribe link in the emails they receive, or by contacting customer service.

8.1.2 After reconfirmation, the Member will then be automatically unsubscribed and will no longer be able to benefit from the advantages of the Program.

8.2 Termination by LADUREE

8.2.1 LADUREE reserves the right to modify the Program at any time, without prior notice. Such modifications will be communicated to the Member by any means within a reasonable period of time. In the event of refusal of these modifications, the Member is free to cancel his or her membership.

8.2.2 LADUREE is entitled to terminate the Program at any time by giving 1 (one) month's notice. In the event of permanent termination of the Program, the Member will be informed by email and will not be entitled to exercise any recourse whatsoever against LADUREE, for any reason whatsoever. The Member then has a period of 3 (three) months from notification of the end of the Program to continue to benefit from the corresponding advantages and to use them if applicable. No claim will be accepted after this period.

ARTICLE 9: Liability

LADUREE may not be held liable for any delay, loss or misdelivery of mail, or for mail being sent to the wrong address, or for telephone or Internet connection problems, which delay or prevent the performance of the obligations for which it is responsible under the Program. Although LADUREE has ensured that all information communicated by the Member or to the Member is correct, LADUREE cannot be held responsible for any errors in the content of the information, nor for any consequences thereof. LADUREE cannot be held responsible for the unavailability of benefits, services and exclusive offers.


ARTICLE 10 : Applicable law

The present General Conditions are governed by French law to the exclusion of any other. The Member has the possibility of appealing to a consumer mediator, under the conditions set out in articles L.611-1 et seq. of the French Consumer Code. Any dispute that cannot be resolved amicably will be brought before the competent court in accordance with the provisions of common law.Â
